What is an "uncontested divorce"?"

An uncontested divorce is when two parties have come to an agreement regarding all the issues without the help of an attorney. When I say all the issues, I mean ALL the issues. Who the children are going to live with, what the other parent’s visitation schedule will be, how much child support will be paid, who will pay the health insurance, and the division of each and every asset from the 401K down to the last knife and fork in the house.

Uncontested divorces are fairly inexpensive because essentially an attorney is only hired to prepare the paperwork properly and finalizing the divorce by taking their client in front of a judge. In Bexar County, if parties can agree on all issues the divorce process can begin and end within approximately 60 days as opposed to taking years in litigation.

However, just because parties do not agree on each and every issue does not mean they have to go in front of a judge and say mean things about the person they were married to. There are other forms of dispute resolution such as mediation and negotiation that can help parties resolve their differences even though it’s not a truly uncontested divorce.
