Can I Get Spousal Support After A Divorce?

Divorces are a difficult and complex process, both for the spouses and the children involved.  Assets and properties are divided, child custodial rights are determined, and financial arrangements for child support are made.  One form of support not as common in Texas is spousal support, or alimony, which is court-ordered financial provision for a spouse after a divorce.  Although Texas does not automatically grant spousal support after a divorce, it is possible to request it to ensure funds are available to pay necessary living expenses.    

Individuals interested in seeking spousal support during or after a divorce should note its limited availability, as well as the many steps involved in demonstrating true need for financial support.  The family court judge must review many different types of evidence in order to render a decision regarding spousal support.  Evidence reviewed may include the length of the relationship and marriage, current living expenses and financial needs, future earnings potential, proof of disability or other extenuating circumstances, and confirmation that the former spouse cannot meet minimum reasonable needs without spousal support.

Unfortunately, many individuals are not well represented in family court, and they are unable to clearly demonstrate their needs to the judge, resulting in little to no spousal support.  This can leave individuals facing undue hardships and struggles, especially for custodial parents of young children who must now pay for living expenses, groceries, medical expenses and childcare with a single income.  Although child support payments can help offset those costs, it can still be daunting for custodial parents to meet financial needs on a much smaller budget than during the marriage. 

Family court judges must also determine the amount and length of time for spousal support, since living expenses can rise and fall over time.  In addition, health conditions may also be considered since the illness or health issues of one spouse could cause them to face high medical and living expenses for care, in addition to reduced earnings potential if they are unable to work full-time.
