Attorney-Client Confidentiality in a Family Law Matter

What communications are confidential?

Unless the communication relates to a future crime to possibly be committed or relates to abuse or neglect of a child, all communications with the attorney are confidential.  The attorney has an ethical duty to maintain this confidentiality, and cannot be compelled to reveal these communications.  

Why are attorney-client communications confidential?

The purpose of the confidentiality rules is to ensure that a client can receive the best legal advice and representation possible.   For the client to obtain effective legal representation, all communications need to be completely open and honest.    

How is being completely candid with my attorney helpful to my legal matter?

The attorney will need all relevant information in order to develop an effective strategy for representation in the legal matter.  Knowing all pertinent information, even if it puts the client in a bad light, is extremely important as it allows the attorney to prepare an adequate response to any negative information.  If harmful information is presented in Court by surprise, Court rules may prohibit the attorney from being able to effectively counter the negative information. Therefore, being completely open and candid with the attorney from the very beginning will allow the attorney to prepare an adequate response and is therefore critical to maximizing your chances of success.
